Vapers in Michigan can continue to buy flavored vape products thanks to an injunction issued by Judge Cynthia Diane Stephens in the Michigan Court of Claims.
Judge Stephens ruled in favor of plaintiffs Marc Slis, 906 Vapor, and A Clean Cigarette Corp. in their case against Commissioner Gretchen Whitmer and the Michigan Department of Health and Human Services. As a result, the emergency order is temporarily suspended. The two plaintiffs have shown that they would suffer severe damages if the ban were upheld while the trial proceeds.
This means that vape businesses can continue to sell flavored e-liquids to adult vapers. According to the lawyers involved, this injunction could last for several months until the lawsuit is resolved.
The state can still appeal, however, and both Commissioner Whitmer and Attorney General Dana Nessel said Tuesday that's what they will do. Whitmer said she will appeal directly to the state Supreme Court.
